1. (a) If prior to the public hearing on an application, an applicant wishes to amend the application in a manner the executive director determines is material, the executive director shall prepare a staff report pursuant to section 13057 and the commission shall vote on the amended application only if:

   1. (1) The applicant agrees in writing to extend the final date for public hearing or
   2. (2) The executive director determines that staff does not need additional time to prepare the staff report or provide notice to the public.

2. (b) If at the public hearing on an application, an applicant wishes to amend the application in a manner the executive director determines is material, the commission may vote on the amended application at that public hearing if:

   1. (1) Adequate public notice has already been provided and
   2. (2) The proposed amended project was adequately reviewed during the public hearing.
3. (c) Conditions recommended by the executive director or imposed by previous commission action shall not be considered an amendment to the application.
