1. (a) An applicant may appeal the Executive Director's decision not to file an application. The appeal shall be in the form of a letter to the Executive Director. The letter shall explain the reasons for the appeal and include all facts and materials the applicant believes are relevant to the appeal.
2. (b) The applicant shall submit the letter of appeal within ten (10) working days of receiving written notice of the Executive Director's decision not to file the application.
3. (c) The Executive Director shall schedule the appeal for hearing and vote by the Commission as soon as practicable following receipt of the applicant's appeal letter.
4. (d) The Commission shall by a majority vote of those present and voting determine whether to uphold the Executive Director's determination or to order the permit application filed.
