1. (a) This article applies to each vessel used on waters subject to the jurisdiction of the State of California and on the high seas for vessels whose last port of call was within the State of California that:

   1. (1) Is used by its operator for recreational purposes; or
   2. (2) Is required to be numbered under Section 9850 of the California Vehicle Code.
2. (b) This article does not apply to a vessel required to have a certificate of inspection under Chapter 1 of Title 46, Code of Federal Regulations.
