1. (a) A separate “person in charge” must be designated for the oil transfer operations of the transfer unit and for the oil transfer operations of the receiving unit.

2. (b) No person may serve as person in charge of oil transfer operations unless:

   1. (1) the person in charge meets the requirements set forth in 33 CFR 154.710, 33 CFR 155.710 and 156.115, whichever is appropriate.
   2. (2) the person in charge has been designated in writing in accordance with 33 CFR 155.820 as set forth in 33 CFR 154.730, and 33 CFR 155.715.
