1. (a) Such device shall operate so that, with engine maintenance which is characteristic of general usage by the users thereof, its emissions are within the limits established by the State Standards.
2. (b) Function or malfunction of the device shall not create a hazardous condition.

No device controlling exhaust emissions from portable and from mobile internal combustion engines used in enclosed structures shall be certified by the Air Resources Board unless it meets the following criteria:
