Rental Agency Requirements.

(a) Starting January 1, 2026, a Rental Agency in California shall not rent out, offer for rent, deliver, or keep within its Revenue Fleet an LSI Forklift unless:
- (1) The Forklift is a 2025 or previous MY LSI Forklift, the Forklift has not yet been phased out according to the phase-out schedules applicable to the Rental Agency set forth in Section 3006(d), and the Rental Agency is in compliance with all other applicable provisions of the Fleet Phase-Out Provisions set forth in Section 3006; or
- (2) The Forklift is a Class V LSI Forklift with a Rated Capacity greater than 12,000 pounds that the Rental Agency has reported to the Executive Officer in accordance with Section 3009(h).
- (b) Until January 1, 2038, the requirements in subsection (a) do not apply if the Forklift is a 2026, 2027, or 2028 MY Class V LSI Forklift acquired prior to January 1, 2029, and the Rental Agency is in compliance with all other applicable provisions of the Fleet Phase-Out Provisions set forth in Section 3006.
