- (a) A vehicle purchaser opting to participate in the Clean Vehicle Rebate Project shall not apply for a Clean Air Vehicle Decal, unless the purchaser's income and the vehicle type allows for participation in both programs, pursuant to Vehicle Code section 5205.5.
- (b) If the vehicle purchaser opts to participate in the Clean Vehicle Rebate Project, the purchaser must return any previously issued Clean Air Vehicle Decals to the department, either at a department field office or by sending the decals to the Department of Motor Vehicles, PO BOX 997601, M/S D238, Sacramento, CA 95899-7601, with a Statement of Facts, form REG 256 (Rev. 8/2008), which is hereby incorporated by reference, completing Section G with an indication that the decals are being returned because the purchaser is participating in the Clean Vehicle Rebate Project, and Section H completed and signed by the purchaser.
- (c) The department will verify, on a randomized basis, the status of vehicles in the Clean Vehicle Rebate Project and will not issue a Clean Air Vehicle Decal to a vehicle purchaser who has applied for or received a rebate, unless the purchaser qualifies for participation in both programs.
- (d) If the rebate was denied, the vehicle owner may reapply for a Clean Air Vehicle Decal, as specified in Section 156.00, with proof of rebate denial.
