CSAAVE Evaluation Criteria.

(a) CSAAVE shall issue a grant of approval of an application for approval submitted pursuant to Section 2501 when the educational institution and its programs of education are found upon investigation to have met the following criteria:
- (1) The educational institution and its programs of education comply with all requirements set forth in Title 38 Code of Federal Regulations part 21.4253 or 21.4254, as applicable, and Education Code section 67102.5, and all other requirements used in consideration for a grant of program of education approval by CSAAVE;
- (2) The educational institution and its programs of education do not engage in substantial misrepresentation as described in Title 38 U.S. Code section 3696(b)(1);
- (3) The educational institution and its programs of education do not make any untrue or misleading statement of, or involving a name or logo to state or imply that it is affiliated with a public entity, private corporation, or association, when it is not, or that it has been approved or endorsed by CSAAVE, when it has not;
- (4) The educational institution and its programs of education do not violate Title 38 Code of Federal Regulations part 21.4252 or applicable parts of Business and Professions Code section 17500; and
(5) If the educational institution makes implied or express representations that it prepares students to work in a profession, occupation, trade, or career field requiring licensing or certification by this state, it shall be approved by the appropriate state licensing or certifying agency to conduct that program of education, and comply with Title 38 U.S. Code section 3676(c)(14) and (15) as applicable.
- (A) CSAAVE shall deny approval of an application for approval if the educational institution makes any implied or express representations that it prepares students to work in a profession, occupation, trade, or career field requiring licensing or certification by this state, and the program of education is not approved by the appropriate state licensing or certifying agency, or fails to comply with Title 38 U.S. Code section 3676(c)(14) and (15), as applicable.
- (b) An application for approval submitted pursuant to Section 2501 shall include the documents required in Sections 2501 and 2503 of this chapter, as applicable. CSAAVE shall notify the educational institution if their application for approval is incomplete due to a failure to include all required documents. Upon receiving notification of an incomplete application, an educational institution desiring to enroll students eligible for federal Title 38 awards shall submit a new application for approval pursuant to Section 2501.
- (c) CSAAVE shall conduct an on-site visit to the locations defined in Title 38 Code of Federal Regulations part 21.4266(a) to determine compliance with requirements for CSAAVE approval for federal Title 38 awards.
- (d) CSAAVE shall deny an application for approval when the educational institution or its programs of education are found upon investigation to fail to meet the criteria of this section.
