- (a) “Accreditation status” means the institution's approval status as accredited by an accrediting agency recognized by the United States Department of Education.
- (b) “Application for approval,” “application for initial program of education approval,” and “application for renewal” mean the uniform applications for approval as required by Title 38 U.S. Code section 3672A.
- (c) “Career field” means a series of jobs or positions that share similar required skills, duties, and a close occupational relationship.
- (d) “Certification” means a credential awarded or official document attesting to a status or level of achievement by a professional organization, entity, agency, or company that specializes in a particular field.
- (e) “Course,” and “program of education” mean a program of education defined in Title 38 Code of Federal Regulations part 21.7020(b)(23).
- (f) “Deceit” means dishonesty, fraudulent conduct, or false statements made knowing them to be untrue to induce action by some particular person or persons in reliance upon such falsehood.
- (g) “Educational institution” and “institution” mean an institution defined in Title 38 Code of Federal Regulations parts 21.4200(a) and 21.7020(b)(29).
- (h) “Employment market assessment” means an analysis conducted by an institution where there is or will be an implied or express representation that a program of education with a vocational objective may lead to the attainment of a job or employment upon graduation. The employment market assessment shall be conducted within three years of the date the application for initial program of education approval is submitted to the California State Approving Agency for Veterans Education (“CSAAVE”) and must demonstrate the employment demand in the geographical location where the program of education is advertised to students, county by county, within the state.
- (i) “Federal Title 38 awards” means a benefit received by an eligible person or veteran while enrolled in a program of education offered by an educational institution approved by CSAAVE pursuant to Title 38 U.S. Code section 3672.
- (j) “Fraud” means an intentional misrepresentation, deceit, or concealment of a material fact known to the defendant with the intention on the part of the defendant of thereby depriving a person of property or legal rights or otherwise causing injury.
- (k) “Headquartered in California” means a principal central administrative office in California where primary headquarters, related functions and services are performed, directed, controlled, or coordinated including financial, personnel, administrative, legal, planning and similar business functions.
- (l) “Internet website link” means the collection of publicly accessible, interlinked World Wide Web pages accessible, prepared and maintained to share related information on a single domain name.
- (m) “Lawsuit” means a civil legal action by one person or entity against another person or entity, to be decided in a court of law.
- (n) “Licensure” has the same meaning as in Education Code section 94848.
- (o) “Misrepresentation” means the making of false, misleading or deceptive claims, sales, enrollment practices, handbooks or advertisements relating to the institution, its programs of education, products, services, faculty, students or graduates by actual statement, omission, or intimation.
- (p) “Nondegree program of education” means a recognized educational credential, other than a standard college degree as defined in Title 38 Code of Federal Regulations part 21.4200(e), awarded by an institution that signifies satisfactory completion of the requirements of a postsecondary program of education below the associate's level.
- (q) “Occupation” means a type of work or job in a designated employment field.
- (r) “On-site visit” means a visit conducted by CSAAVE to any of the locations defined in Title 38 Code of Federal Regulations part 21.4266(a) to determine compliance with requirements for CSAAVE approval for federal Title 38 awards.
- (s) “Passage rate” has the same meaning as in Education Code section 94929.5(a)(2).
- (t) “Pending lawsuit” means a proceeding in a court of law whose activity is in progress but not yet completed or adjudicated.
- (u) “Profession” means a type of fixed work requiring specialized training, skills, and a higher level of education, or license.
- (v) “Public prosecutor” means a district attorney, city attorney, city prosecutor, county counsel, or an Attorney General.
- (w) “Renewal” means an approval issued to an institution that is issued subsequent to the initial effective date of the grant of approval and prior to its expiration.
- (x) “Representation” means making statements, claims or advertisements relating to the institution, it's programs of education, products, services, faculty, students or graduates.
- (y) “Resolved lawsuit” means a resolution in a formal statement of opinion, decision to take an action or judgement by the court in a judicial proceeding.
- (z) “School Performance Fact Sheet” means the documents as listed in Education Code section 94910.
- (aa) “State license or certificate” means an official document issued by a board, bureau, commission, department, program, or agency to engage in the practice of a profession, vocation or trade.
- (bb) “State licensing or certifying agency” means any board, bureau, commission, department, program, or agency designated or authorized by law to issue a license or certification to engage in the practice of a profession, vocation or trade.
- (cc) “Trade” means a type of work requiring specialized knowledge, skills, competencies, and qualifications in a designated field of construction.
- (dd) “Year” has the same meaning as in Education Code section 94871.
For purposes of this chapter, the following definitions shall apply:
