(a) A “temporarily prohibited” person refers to a person who is prohibited from owning or possessing a firearm, ammunition feeding device, or ammunition pursuant to any law, if the prohibition expires on a specific ascertainable date. Upon taking possession of a temporarily prohibited person's firearm, ammunition feeding device, or ammunition pursuant to Penal Code section 29830, a firearm dealer or ammunition vendor shall report the following information to the Department:
(1) California Firearm Dealer number or Ammunition Vendor number, dealer or vendor name (as shown on license), business address and telephone number.
- (A) The name of the dealer or vendor representative who took possession of the firearm, ammunition feeding device, or ammunition.
- (2) The date that the dealer or vendor took possession of the firearm, ammunition feeding device, or ammunition.
- (3) The name, date of birth, physical address, gender, identification type and number of the person relinquishing the firearm, ammunition feeding device, or ammunition for storage.
(4) A description of the item(s) being stored:
- (A) For firearms: A description of the firearm, including firearm type (i.e., handgun, rifle, shotgun, rifle/shotgun combination, or other), category (i.e., bolt action, carbine, double barrel, three barrels, four or more barrels, derringer, lever action, over and under, pump action, revolver, semi-automatic, or single shot), make, model, caliber, color, and serial number.
- (B) For ammunition feeding devices: A description of the feeding device type (i.e., speed loader, clip, belt, drum magazine, or box magazine) and quantity of devices. A belt or magazine description must indicate whether the capacity is standard or large-capacity, as defined in Penal Code section 16740.
- (C) For ammunition as defined in Penal Code section 16150, subdivision (b): A description of the manufacturer, condition (i.e., new, reload or used) and caliber.
- (b) The dealer or vendor shall report the information in subdivision (a) through the DROS Entry System (DES).
