Cal. Code Regs. tit. 11, § 999.309 – Other Misconduct.

(a) The adjudication of Covered Misconduct may be combined with the adjudication of related offenses that are not Covered Misconduct.
(b) Where there is evidence to Sustain a charge of Covered Misconduct, the Employing Agency, Adjudicating Agency, or any other agency so empowered shall not enter into any agreement with the Subject to withdraw the Charge of Covered Misconduct, including where such withdrawal is made in exchange for the Subject accepting discipline other than removal from appointment as a Peace Officer.
