1. (a) A guaranteed association shall be disqualified from participation in the program if any of the following occur:

   1. (1) It is found by the program to no longer be a qualified guaranteed association.
   2. (2) It so requests in writing. Such requests shall be provided to the program at least sixty (60) calendar days prior to the effective date of the requested disqualification.
   3. (3) It has committed an act of fraud or misrepresentation to circumvent the statutes or regulations of the program.

2. (b) When a participating guaranteed association is disqualified, the program shall notify the guaranteed association of the disqualification.

   1. (1) The notice shall be in writing and include the following information:

      1. (A) The reason for the disqualification,
      2. (B) The effective date of disqualification, and
      3. (C) That all guaranteed association members and dependents shall be disenrolled and the final day of coverage provided by the program through the guaranteed association.
