OTHER POSITIONS
Consultants/New Positions
*
* Consultants/new positions shall be included in the list of designated positions and shall disclose pursuant to Category 1 subject to the following limitation:
The Commissioner or their designee may determine in writing that a particular consultant or new position, although a “designated position,” is hired to perform a range of duties that is limited in scope and thus is not required to comply fully with the disclosure requirements described in this section. Such written determination shall include a description of the consultant's or new position's duties and, based on that description, a statement of the extent of the disclosure requirements. The Commissioner's or their designee's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict of interest code. (Gov. Code Sec. 81008.)
Note: The Insurance Commissioner is covered by Government Code Section 87200, and as such, must file a statement of economic interests pursuant to Government Code Section 87200 and not pursuant to the Department's conflict of interest code.
Note: Authority cited: Section 87300, Government Code. Reference: Sections 87302(a), 87302(b) and 87302(c), Government Code.

Amendment of section heading and repealer and new section filed 3-4-2013; operative 4-3-2013 (FPPC regulations only subject to 1974 Administrative Procedure Act rulemaking requirements and not subject to procedural or substantive review by OAL). Approved by Fair Political Practices Commission 1-15-2013 to replace the conflict-of-interest code amendments filed on 4-12-2010 and 3-15-2012, which are both void due to the agency's failure to properly follow the notice requirements of the Political Reform Act.
