1. A. That the proposed plan of business of the applicant and the proposed issuance of securities are fair, just and equitable;
2. B. That applicant intends fairly and honestly to transact its business; and
3. C. That the securities applicant proposes to issue and the methods to be used by it in issuing or disposing of them are such as, in the Commissioner's opinion, will not work a fraud upon the purchasers of the securities or upon policyholders or other security holders of applicant.

Every application for a securities permit must show either in the body of the application or by exhibits sufficient facts to enable the Commissioner to make the findings required by Insurance Code Section 839, to wit:
