1. (a) the manual contents violate any provision of the Insurance Code, or
2. (b) the actuarial analyses underlying the contents of the manual are not actuarially sound according to the standards contained in the Statement of Principles Regarding Property and Casualty Insurance Ratemaking of the Casualty Actuarial Society (CAS) or other generally accepted actuarial standards.

A manual shall not be found to contemplate activities or practices that are unfair, unreasonable or otherwise inconsistent with the provisions of the Insurance Code based on the grounds that the contents of the manual fails to meet technical or actuarial requirements unless:
