(a) The following criteria shall apply to procedures employed by the Commissioner in considering and issuing licenses:
- (1) If the submitted application and/or forms provided in Section 2194.25 of these regulations, are deficient, the Commissioner shall, within twenty-one (21) calendar days of receipt of the license application, inform the applicant, in writing, by mail or email, that the application and/or forms are deficient and what specific information is required for completion.
- (2) The Commissioner shall, within thirty (30) calendar days of the filing of a completed application, reach a decision whether to issue or deny a license, and shall notify the applicant of the decision. If the Commissioner has decided to deny the application, the reason(s) shall be set forth in the notification.
- (b) The period set forth above in paragraph 2194.26(a)(2) shall be tolled in the event the application requires additional investigation or action pursuant to Article 6 of Chapter 5 of Part 2 of Division 1 of the California Insurance Code. In such instances, the time will be tolled until said investigation or action is concluded.
