1. (a) Not less than one business day before the date on which an applicant proposes to convert into a subject institution and on which such subject institution proposes to commence business, such applicant shall file with the Commissioner an application for the institution to transact commercial banking business, trust business, or both, as the case may be. Such application shall state:

   1. (1) Name of the subject institution.
   2. (2) Address of the head office of the subject institution.
   3. (3) Date on which the applicant proposes to convert into the subject institution and on which the subject institution proposes to commence business.
2. (b) The application called for in Subdivision (a) of this Section shall be accompanied by the fee prescribed in Financial Code Section 4839(c)(2).
