A. A hospital or facility in this state where abortions are performed must submit to the department of health services on a form prescribed by the department a report of each abortion performed in the hospital or facility. The report shall not identify the individual patient by name or include any other information or identifier that would make it possible to identify, in any manner or under any circumstances, a woman who has obtained or sought to obtain an abortion. The report must include the following information:

1. 1. The name and address of the facility where the abortion was performed.
2. 2. The type of facility where the abortion was performed.
3. 3. The county where the abortion was performed.
4. 4. The woman's age.
5. 5. The woman's educational background by highest grade completed and, if applicable, level of college completed.
6. 6. The county and state in which the woman resides.
7. 7. The woman's race and ethnicity.
8. 8. The woman's marital status.
9. 9. The number of prior pregnancies and prior abortions of the woman.
10. 10. The number of previous spontaneous terminations of pregnancy of the woman.
11. 11. The gestational age of the unborn child at the time of the abortion.

12. 12. The reason for the abortion, including at least one of the following:

    1. (a) The abortion is elective.

    2. (b) The abortion is due to maternal health considerations, including one of the following:

       1. (i) A premature rupture of membranes.
       2. (ii) An anatomical abnormality.
       3. (iii) Chorioamnionitis.
       4. (iv) Preeclampsia.
       5. (v) Other.

    3. (c) The abortion is due to fetal health considerations, including the fetus being diagnosed with at least one of the following:

       1. (i) A lethal anomaly.
       2. (ii) A central nervous system anomaly.
       3. (iii) Other.
    4. (d) The pregnancy is the result of a sexual assault.
    5. (e) The pregnancy is the result of incest.
    6. (f) The woman is being coerced into obtaining an abortion.
    7. (g) The woman is a victim of sex trafficking.
    8. (h) The woman is a victim of domestic violence.
    9. (i) Other.
    10. (j) The woman declined to answer.
13. 13. The type of procedure performed or prescribed and the date of the abortion.
14. 14. Any preexisting medical conditions of the woman that would complicate pregnancy.

15. 15. Any known medical complication that resulted from the abortion, including at least one of the following:

    1. (a) Shock.
    2. (b) Uterine perforation.
    3. (c) Cervical laceration requiring suture or repair.
    4. (d) Heavy bleeding or hemorrhage with estimated blood loss of at least five hundred cubic centimeters.
    5. (e) Aspiration or allergic response.
    6. (f) Postprocedure infection.
    7. (g) Sepsis.
    8. (h) Incomplete abortion retaining part of the fetus requiring reevacuation.
    9. (i) Damage to the uterus.
    10. (j) Failed termination of pregnancy.
    11. (k) Death of the patient.
    12. (l) Other.
    13. (m) None.
16. 16. The basis for any medical judgment that a medical emergency existed that excused the physician from compliance with the requirements of this chapter.
17. 17. The physician's statement if required pursuant to section 36-2301.01.
18. 18. If applicable, the weight of the aborted fetus for any abortion performed pursuant to section 36-2301.01.
19. 19. Whether a fetus or embryo was delivered alive as defined in section 36-2301 during or immediately after an attempted abortion and the efforts made to promote, preserve and maintain the life of the fetus or embryo pursuant to section 36-2301.
20. 20. Statements by the physician and all clinical staff who observed the fetus or embryo during or immediately after the abortion certifying under penalty of perjury that, to the best of their knowledge, the aborted fetus or embryo was not delivered alive as defined in section 36-2301.

21. 21. The medical specialty of the physician performing the abortion, including one of the following:

    1. (a) Obstetrics-gynecology.
    2. (b) General or family practice.
    3. (c) Emergency medicine.
    4. (d) Other.

22. 22. The type of admission for the patient, including whether the abortion was performed:

    1. (a) As an outpatient procedure in an abortion clinic.
    2. (b) As an outpatient procedure at a hospital.
    3. (c) As an inpatient procedure at a hospital.
    4. (d) As an outpatient procedure at a health care institution other than an abortion clinic or hospital.
23. 23. Whether anesthesia was administered to the mother.
24. 24. Whether anesthesia was administered to the unborn child.
25. 25. Whether any genetic abnormality of the unborn child was detected at or before the time of the abortion by genetic testing, such as maternal serum tests, or by ultrasound, such as nuchal translucency screening, or by other forms of testing.
26. 26. If a surgical abortion was performed, the method of final disposition of bodily remains and whether the woman exercised her right to choose the final disposition of bodily remains.
