If the shared vehicle is an individual-owned shared vehicle, a peer-to-peer car sharing program is not either of the following:

1. 1. In the business of leasing or renting for less than one year motor vehicles for hire without a driver as described in section 5-839, subsection C.
2. 2. Subject to the surcharge collected pursuant to section 48-4234.
