This article applies only to advanced air mobility aircraft, including an eCTOL, eVTOL and a powered lift aircraft, that have both of the following:

1. 1. A gross takeoff weight of three hundred pounds or more.
2. 2. The capability of carrying passengers as defined in section 28-8201 or cargo.
