1. 1. Policies and procedures are established, documented, and implemented that cover when informed consent is required and by whom informed consent may be given; and

2. 2. The behavioral health services:

   1. a. Are provided under the direction of a behavioral health professional; and

   2. b. Comply with the requirements:

      1. i. For behavioral health paraprofessionals and behavioral health technicians, in R9-10-115; and
      2. ii. For an assessment, in R9-10-1011(B).

If an outpatient surgical center is authorized to provide behavioral health services, an administrator shall ensure that:
