1. A. Except as provided in subsection (B), an administrator shall ensure that:

   1. 1. A personnel member coordinates the transport and the services provided to the patient;

   2. 2. According to policies and procedures:

      1. a. An evaluation of the patient is conducted before and after the transport,
      2. b. Information from the patient’s medical record is provided to a receiving health care institution,
      3. c. A personnel member explains risks and benefits of the transport to the patient or the patient’s representative; and
      4. d. A personnel member communicates or documents why the personnel member did not communicate with an individual at a receiving health care institution;

   3. 3. The patient’s medical record includes documentation of:

      1. a. Communication or lack of communication with an individual at a receiving health care institution;
      2. b. The date and time of the transport;
      3. c. The mode of transportation; and
      4. d. If applicable, the name of the personnel member accompanying the patient during a transport.

2. B. Subsection (A) does not apply to:

   1. 1. Transportation to a location other than a licensed health care institution,
   2. 2. Transportation provided for a patient by the patient or the patient’s representative,
   3. 3. Transportation provided by an outside entity that was arranged for a patient by the patient or the patient’s representative, or
   4. 4. A transport to another licensed health care institution in an emergency.

3. C. Except for a transfer of a patient due to an emergency, an administrator shall ensure that:

   1. 1. A personnel member coordinates the transfer and the services provided to the patient;

   2. 2. According to policies and procedures:

      1. a. An evaluation of the patient is conducted before the transfer;
      2. b. Information from the patient’s medical record, including orders that are in effect at the time of the transfer, is provided to a receiving health care institution; and
      3. c. A personnel member explains risks and benefits of the transfer to the patient or the patient’s representative; and

   3. 3. Documentation in the patient’s medical record includes:

      1. a. Communication with an individual at a receiving health care institution;
      2. b. The date and time of the transfer;
      3. c. The mode of transportation; and
      4. d. If applicable, the name of the personnel member accompanying the patient during a transfer.
