1. A. A licensee providing child care services for school-age children shall:

   1. 1. Ensure that a staff member supervises an enrolled school-age child to and from a bathroom and allows the enrolled child privacy while in the bathroom;
   2. 2. Ensure that if an enrolled child remains in the bathroom for more than three minutes, the supervising staff member checks on the enrolled child to ensure the child’s safety;

   3. 3. Provide age-appropriate toys, materials, and equipment accessible to enrolled children in a quantity sufficient to meet the needs of the enrolled children in attendance including:

      1. a. Arts and crafts,
      2. b. Games,
      3. c. Puzzles and toys to enhance manipulative skills,
      4. d. Books,
      5. e. Science materials,
      6. f. Sports equipment, and
      7. g. Outdoor play equipment;
   4. 4. Provide enrolled school-age children with a quiet study area;
   5. 5. Ensure that if drinking water is not accessible in an indoor or outdoor activity area, drinking water is available to meet the individual needs of each enrolled school-aged child; and
   6. 6. Ensure that, when a parent permits, a staff member allows an enrolled school-age child to possess and use a topical sunscreen product without a note or prescription from a licensed health care professional.

2. B. A school age out-of-school time program provider shall:

   1. 1. Operate after school, before school, or during a time when school is not in session;
   2. 2. Serve school-age children; and
   3. 3. Promote expanded childhood learning, enrichment, child and youth development, or educational, recreational, or character-building activities.
