1. A. A petition to the Department for rulemaking under A.R.S. § 41-1033 shall include:

   1. 1. The name and address of the individual who submits the petition;

   2. 2. An identification of the rulemaking, including:

      1. a. A statement of the rulemaking sought,
      2. b. The Arizona Administrative Code citation of each existing rule included in the petition, and
      3. c. A description of each new rule included in the petition;
   3. 3. The specific text of each new rule or amendment;

   4. 4. The reasons for requesting the rulemaking, supported by:

      1. a. Statistical data;
      2. b. If the statistical data refers to exhibits, the exhibits;
      3. c. An identification of the persons who would be affected by the rulemaking and the type of effect; and
      4. d. Other information supporting the rulemaking;
   5. 5. The signature of the individual who submits the petition;
   6. 6. The date the petition is signed; and
   7. 7. A copy of each existing rule included in the petition.

2. B. A petition to the Department under A.R.S. § 41-1033 for review of a Department practice or substantive policy statement that allegedly constitutes a rule shall include:

   1. 1. The name and address of the individual who submits the petition,
   2. 2. An identification of a Department practice or substantive policy statement that allegedly constitutes a rule,
   3. 3. The signature of the individual who submits the petition,
   4. 4. The date the petition is signed, and
   5. 5. A copy of the Department’s substantive policy statement or a description of the Department’s practice.
3. C. The Department shall notify an individual who submits a petition according to A.R.S. § 41-1033 of the Department’s decision in writing within 60 calendar days after receipt of the petition.
4. D. If the Department denies a petition submitted according to A.R.S. § 41-1033, the individual who submitted the petition may proceed according to A.R.S. §§ 41-1033 or 41-1034.
