1. A. Except for misuse of funds or failing to submit debit card transaction expense receipts pursuant to R7-2-1508, if the Department finds that a parent violated A.R.S. § 15-2401 et seq, this Article or the terms and conditions set forth by the Department in the contract signed by the parent, the Department shall:

   1. 1. Temporarily suspend the account;
   2. 2. Provide notice to the parent of the violation, including an explanation of the violation; and
   3. 3. Provide the parent 15 days to correct the violation.
2. B. The Department may remove a parent or qualified student from the Program for failing to correct a violation pursuant to this Section.
3. C. Pursuant to R7-2-1511, a parent or qualified student who has been removed from the Program pursuant to this Section may file a written request for a hearing within 30 days after being served the notice of removal.
