1. A. The Department may pay benefits to a person acting as representative for, or on behalf of, a caretaker relative who was receiving benefits for a dependent child, when the relative:

   1. 1. Dies,
   2. 2. Abandons or deserts the child,
   3. 3. Is incarcerated, or
   4. 4. Is committed to a hospital for the mentally ill.
2. B. The Department can make payments to the emergency payee for 90 days, or until a case plan is developed for the dependent child, whichever first occurs.
