A. WIOA Title I-B Adult Program. An Applicant is eligible to receive Career Services provided through the WIOA Title I-B Adult Program if an Applicant:
- 1. Is 18 years of age or older, and
- 2. Complies with Selective Service requirements in Section 3 of the Military Services Act, as amended by 50 U.S.C. 3802, under Section 189(h) of the WIOA.
B. WIOA Title I-B Dislocated Worker Program. An Applicant is eligible to receive Career Services provided through the Dislocated Worker Program if the Applicant:
- 1. Meets minimum eligibility criteria. The Applicant complies with Selective Service requirements in Section 3 of the Military Services Act, as amended by 50 U.S.C. 3802, under Section 189(h) of the WIOA.
2. Meets any of the following criteria in addition to subsection (B)(1):
a. Has been terminated or laid off, or who has received a notice of termination or layoff, from employment; and
- i. Is eligible for or has exhausted entitlement to unemployment compensation; or
- ii. Has been employed for a duration sufficient to demonstrate attachment to the workforce, as determined on a case-by-case basis by a Service Provider, but is not eligible for unemployment compensation due to insufficient earnings or having performed services for an employer that were not covered under State unemployment compensation law; and
- iii. Is unlikely to return to a previous industry or occupation.
b. Was dislocated because the individual:
- i. Has been terminated or laid off, or has received a notice of termination or layoff, from employment as a result of any permanent closure of, or any substantial layoff at, a plant, facility, or enterprise:
- ii. Is employed at a facility at which the employer has made a general announcement that such facility will close within 180 calendar days; or
- iii. Is employed at a facility at which the employer has made a general announcement that such facility will close.
- c. Was self-employed, including employment as a farmer, a rancher, or a fisherman, but is unemployed as a result of general economic conditions in the community in which the individual resides or because of natural disasters;
- d. Is a Displaced Homemaker; or
e. Is the spouse of a member of the United States Armed Forces on active duty, and who:
- i. Experienced a loss of employment as a direct result of relocation to accommodate a permanent change in duty station of such member; or
- ii. Is Unemployed or Underemployed and experiencing difficulty in obtaining or upgrading employment.
C. WIOA Title I-B Youth Program. An Applicant is eligible to receive services through the Youth Program if the Applicant:
- 1. Meets minimum eligibility criteria. The Applicant complies with Selective Service requirements in Section 3 of the Military Services Act, as amended by 50 U.S.C. 3802, under Section 189(h) of the WIOA.
2. Is either an In-School Youth or Out of School Youth.
a. An Applicant is an In-School Youth if the Applicant is:
- i. Age 14 through 21, unless the Applicant is a Child With a Disability receiving educational services in secondary school;
- ii. Attending school as described under A.R.S. § 15-802, including secondary and postsecondary school;
iii. Low income; and
- (1) Basic Skills Deficient;
- (2) An English Language Learner;
- (3) An Offender;
- (4) A Homeless Individual, a Homeless Child or Youth, or a Runaway;
- (5) In foster care, has aged out of the foster care system or who has attained 16 years of age and left foster care for kinship guardianship or adoption, a child eligible for assistance under the John H. Chafee Foster Care Program for Successful Transition to Adulthood, under 42 U.S.C. 677, or in an out-of-home placement;
- (6) Pregnant or parenting;
- (7) A Child With a Disability receiving educational services in secondary school; or
- (8) An individual who requires additional assistance, as defined by the LWDA, to complete an education program or hold employment.
b. An Applicant is an Out-of-School Youth if the Applicant is:
- i. Age 16 through 24;
ii. Not attending any school as described under A.R.S. § 15-802; and
- (1) A School Dropout;
- (2) A recipient of a secondary school diploma or recognized equivalent who is a Low-Income Individual and is either Basic Skills Deficient or an English Language Learner;
- (3) An Offender;
- (4) A Homeless Individual, a Homeless Child or Youth, or a Runaway;
- (5) In foster care, has aged out of the foster care system or who has attained 16 years of age and left foster care for kinship guardianship or adoption, a child eligible for assistance under the John H. Chafee Foster Care Program for Successful Transition to Adulthood, under 42 U.S.C. 677, or in an out-of-home placement;
- (6) Pregnant or parenting;
- (7) An individual with a Disability; or
- (8) A Low-Income Individual who requires additional assistance, as defined by the LWDB, to enter or complete an educational program or to secure or hold employment.
- D. An Applicant may be eligible to receive services or assistance in more than one program, as described under U.S.C. 3174(c)(3)(A)(i).
