1. A. If the Department has terminated Child Care Assistance, the Department shall not reinstate assistance unless the client files a new application.

2. B. Notwithstanding subsection (A), the Department shall reinstate assistance within 10 calendar days when:

   1. 1. Termination was due to Department error; the Department shall reinstate assistance effective the date following the date of termination;
   2. 2. The Department receives a court order or administrative hearing decision mandating reinstatement; the Department shall reinstate assistance effective the date prescribed by the court order or hearing decision; or
   3. 3. The recipient files a request for a fair hearing within 10 days of the notice date of the termination notice and requests that assistance be continued pending the outcome of an appeal; the Department shall reinstate assistance effective the date following the date of termination.
