1. A. The Director may dismiss, upon written determination, an appeal in whole or in part before scheduling a hearing if:

   1. 1. The appeal does not state a valid basis for protest;
   2. 2. The appeal is untimely as prescribed under R2-7-A905; or
   3. 3. The appeal attempts to raise issues not raised in the protest.
2. B. The Director shall notify the interested party, the agency chief procurement officer, and the state procurement administrator in writing of a determination to dismiss an appeal before hearing.
