As used in this part:

1. (1) “Custody” means immediate charge and physical control of an individual committed by an order of a circuit or juvenile court of the State of Arkansas to the Department of Corrections;
2. (2) “Extended juvenile jurisdiction (EJJ) offender” means a juvenile designated to be subject to juvenile disposition and an adult sentence imposed by the court pursuant to Arkansas Code § 9-27-303; and

3. (3)

   1. (A) “Juvenile records” means reports, correspondence, memoranda, case histories, or other material that personally identifies a juvenile, including protected health information, compiled or received by:

      1. (i) A juvenile detention facility;
      2. (ii) A community-based provider for the Division of Youth Services; or
      3. (iii) The Division of Youth Services.

   2. (B) Records include, but are not limited to, the following:

      1. (i) Psychological evaluations;
      2. (ii) Psychiatric evaluations;
      3. (iii) Education records;
      4. (iv) Medication records;
      5. (v) Program treatment notes;
      6. (vi) Disciplinary records;
      7. (vii) Prison Rape Elimination Act of 2003, 34 U.S.C. § 30301 et seq., related records; and
      8. (viii) Conviction records for sexual or violent crimes committed as a juvenile.
