As used in this section and 9 CAR § 100-511:

1. (1) “Electronic device” means anything that can be used to transmit or capture:

   1. (A) Images;
   2. (B) Sound; or
   3. (C) Data;

2. (2) “Harmful to minors” means any picture, image, graphic file, or other visual depiction that:

   1. (A) Taken as a whole and with respect to minors, appeals to a prurient interest in:

      1. (i) Nudity;
      2. (ii) Sex; or
      3. (iii) Excretion;

   2. (B) Depicts, describes, or represents, in a patently offensive way with respect to what is suitable for minors:

      1. (i) An actual or simulated sexual act or sexual contact;
      2. (ii) An actual or simulated normal or perverted sexual act; or
      3. (iii) A lewd exhibition of the genitals; and
   3. (C) Taken as a whole, lacks serious literary, artistic, political, or scientific value as to minors; and

3. (3) “Social media” means forms of electronic communication such as websites and applications that enable users to:

   1. (A) Create and share:

      1. (i) Information;
      2. (ii) Ideas;
      3. (iii) Personal messages; or
      4. (iv) Other content; or
   2. (B) Participate in online communities and social networking.
