As used in this section and 9 CAR § 100-328:

1. (1) “Secure residential treatment facility” means a Division of Youth Services facility, or a facility operated by a provider under contract with the division, characterized by:

   1. (A) Locked entrances and exits;
   2. (B) Physically restrictive construction, including without limitation locked bedrooms; and
   3. (C) Procedures intended to prevent a youth from departing without the approval of the division or the provider; and

2. (2) “Youth” means an individual between the ages of ten (10) and (20):

   1. (A) Committed by a circuit court to the physical custody of the Division of Youth Services; and
   2. (B) Receiving services at a secure residential treatment facility or program operated by the division or a vendor under contract with the division.
