(a) The Registry Administrator will:
- (1) Prepare forms to be shared with administrators of other agencies when an applicant identifies another agency as the agency having completed the adoption;
(2) Establish office procedures which will ensure the confidentiality of:
- (A) The registry;
- (B) Its records; and
- (C) Identifying information;
- (3) Ensure that information contained in the registry or obtained by registry staff consists of nonidentifying information only;
- (4) Send information packets containing registration requirements, procedures, and an affidavit to any person inquiring about registration;
- (5) Access the agency’s closed adoption records and court records (limited to the act of verifying a registry match or for compilation of nonidentifying information);
- (6) Collect fees for registration services and accept affidavits for registration;
- (7) Provide written notification to qualified registrants as to the status of the initial search of all registrants who wish to be identified;
- (8) Send notification to match registrants by certified mail;
- (9) Determine if nonidentifying information is available and if the registrant is eligible to receive it;
- (10) Provide nonidentiying genetic, health, and social history of the adoptee in the form of a written adoption summary;
- (11) Mail nonidentifying written summary of information to the registrant by certified mail;
- (12) Maintain copies of nonidentifying information in a secured location;
- (13) Keep records of every adult adoptee and birth parent reunited through the use of the Mutual Consent Voluntary Adoption Registry;
(14)
- (A) Provide a deidentified copy of the foster care record to the adoptee upon request.
- (B) Deidentify the names of any reporters of child abuse and/or neglect; and
(15)
- (A) Arrange for an adoptee to review his or her foster care record upon request.
- (B) This access is not available to adoptees who were placed as infants for the sole purpose of adoption.
(b) The Adoption Specialist will:
- (1) Refer any person inquiring about the registry to the Registry Administrator, Adoption Services Unit; and
- (2) Provide a minimum of no less than one (1) hour of counseling to registry applicants for receipt of identifying information and sign the affidavit to verify the service.
