(a) Upon the death of a child who is in a preadoptive placement, the child’s Adoption Specialist will inform the resource parent or parents that:
(1)
- (A) The adoption decree may be finalized through the court, upon parent’s request.
- (B) The parents have thirty (30) days to make such request;
(2) The child’s last name may be:
- (A) Legally changed to that of the adoptive family; and
- (B) Inscribed on a headstone or other memorial marker;
- (3) The child may be buried in a location specified by the family; and
- (4) The Division of Children and Family Services will pay for reasonable, ordinary, and necessary funeral expenses.
(b) Adoption staff will include the following documents in the adoption packet:
- (1) “CFS-432: Checklist for Recommendation for Finalization”;
- (2) Initial home study of the adoptive family and all updates;
- (3) “CFS-418: Adoption Summary” of the child and all updates;
- (4) “CFS-471: Signed Disclosure for Adoption”;
- (5) Report of adoption (accessible at: http://www.healthy.arkansas.gov/images/uploads/pdf/resource);
- (6) Court order terminating parental rights;
- (7) Certified birth certificate of child;
- (8) Federal Bureau of Investigation, state criminal record checks, and child maltreatment checks as applicable;
- (9) “CFS-428: Adoption Assistance”, if applicable;
- (10) Adoption information sheet; and
- (11) Death certificate or medical notes recording the death.
(c)
- (1) The Adoption Supervisor may approve the adoption consent.
- (2) Any denial of a postmortem adoption decree must be reviewed by the Director of the Division of Children and Family Services or designee.
