1. (a) If the child maltreatment allegation is determined to be true, the FSW Caseworker will:

   1. (1) Reassess the corrective action plan for the resource home, if applicable, in collaboration with the FSW Resource Worker and FSW Investigator;

   2. (2)

      1. (A) Remove any or all of the children from the home, determined on a case-by-case basis in consultation with the FSW Supervisor, if necessary, to ensure their safety and well-being.
      2. (B) If the child or children must be removed, refer to 9 CAR § 40-827, changes to out-of-home placement, and related procedures regarding notifications of the placement move;
   3. (3) Hold a staffing within three (3) business days of the determination with the FSW Supervisor, FSW Resource Worker, and, if needed, the FSW Investigator to decide if the corrective action plan for the resource home, if applicable, needs to be revised and/or if changes to the child’s or children’s placement are needed until due process for the resource parents has been met;
   4. (4) Update contacts in the Division of Children and Family Services’ information management system as necessary; and
   5. (5) Update the FSW Resource Worker and Resource Worker Supervisor as necessary.
2. (b) The FSW Resource Worker will update the availability of the resource home and contacts in the division’s information management system as applicable.

3. (c) The Area Director or designee will:

   1. (1) Participate in the staffing upon request to determine if the corrective action plan for the resource home, if applicable, needs to be revised or if changes to the child’s or children’s placement are needed until due process for the resource parents has been met; and
   2. (2) Notify the Assistant Director of Field Operations or designee if the child or children will remain in a resource home with a true determination while due process is pending.
4. (d) The Assistant Director of Field Operations or designee will notify the Director of the Division of Children and Family Services if the child or children will remain in a resource home with a true determination while due process is pending.
