(a)
- (1) The Division of Children and Family Services may secure legal counsel for children in foster care in connection with legal actions and proceedings of which they are a part during their foster care experience.
- (2) This includes but is not limited to fair hearings involving Medicaid or Social Security, administrative hearings to represent the child as an alleged offender of child maltreatment, Special Immigrant Juvenile Status (SIJS) applications, wrongful death, medical malpractice, probate and estate matters, contract issues, and school matters for division cases.
- (b) The division will not secure legal counsel for a child who is not in Department of Human Services custody at the time of the hearing, regardless of whether the child was in department custody at the time the offense was committed.
