(a) The foster parents will:
- (1) Accompany the child to all medical appointments; and
- (2) Inform the Division of Children and Family Services of any scheduled medical visits or medical problems for the child.
(b) Foster parents are authorized to provide consent to medical treatment (excluding mental health services,see 9 CAR § 40-750) for children in their care in the following cases:
(1)
- (A) Emergency situation.
- (B) An “emergency situation” is one (1) in which the proposed surgical or medical treatment or procedures are immediately or imminently necessary and any delay occasioned by an attempt to obtain consent would reasonably be expected to jeopardize the life, health, or safety of the person affected or would reasonably be expected to result in disfigurement or impaired faculties;
- (2) Routine medical treatment;
- (3) Ongoing medical treatment; and
- (4) Nonsurgical procedures by a primary or specialty care provider.
(c) The Family Service Worker or Health Services Specialist will:
- (1) Provide necessary support services to enable foster parents to accompany the child to any medical appointment; and
(2) Provide consent to medical treatment (excluding mental health services — see 9 CAR § 40-750) for children in foster care in the following cases:
- (A) Nonemergency surgical procedures;
- (B) Nonemergency invasive procedures;
- (C) “End of life” nonemergency procedures which include:
(i) Do-not-resuscitate orders, with Director of the Division of Children and Family Services approval and a court order;
(ii) Withdrawal of life support, with director approval and a court order; and
- (iii) Organ donation, with director approval; and
- (D) Nonemergency medical procedures relating to a criminal investigation or judicial proceeding that involves gathering forensic evidence.
