In an emergency situation, a sheriff or police chief may place children in the Division of Children and Family Services foster homes only when the following criteria have been met:
- (1) The sheriff or chief of police contacts the area or county designated on-call worker and does not get a return phone call within thirty (30) minutes;
- (2) Subsequent to not receiving a phone call in the above situation, the sheriff or chief of police contacts the division emergency contact line and does not get a return phone call within fifteen (15) minutes;
(3) The foster parent is personally well-known to the sheriff or the chief of police and the sheriff or chief of police has:
- (A) Determined that the foster parent’s home is safe and provides adequate accommodations for the child; and
- (B) Performed a criminal record and child maltreatment check on the foster parent; and
- (4) The sheriff or chief of police will on the next business day notify the division of the time and date that the child was placed in the foster parent’s home.
