(a) If a Medicaid-eligible child in foster care is denied a Medicaid service and the Family Service Worker disagrees with the denial, the Family Service Worker will:
- (1) Notify the Division of Children and Family Services Client Advocate; and
- (2) Complete a Department of Human Services appeal form (DHS-1200) and provide to the Client Advocate.
(b) The Client Advocate will:
(1)
- (A) Contact the Director of the Division of Medical Services or his or her designee and attempt to resolve the issue by providing any additional information and documentation regarding the child and his or her need for the denied service.
- (B) The issue must be resolved prior to the expiration of the thirty-day Medicaid appeal timeframe, to allow for a formal appeal in the event that the issue cannot be resolved internally; and
(2)
- (A) Notify the FSW when the Division of Medical Services makes a determination as to the outcome of the internal appeal.
- (B) If the denial is upheld, the Client Advocate may initiate an external appeal.
