When the Division of Children and Family Services receives a report that a child is living with or participating in unsupervised visits with a registered sex offender, the division will find the report “unsubstantiated” when:

1. (1) A court has ruled that the registered sex offender, as a custodian or participant in unsupervised visitation does not pose a risk to the child; and
2. (2) No other allegations have been made regarding the offender and the children and the report is simply based on the mere fact that the offender is a registered sex offender.
