1. (a) Upon notification to the Division of Children and Family Services by law enforcement of the presence of a sex offender, the division is responsible to notify foster parents and families with whom the division has active cases, if an offender moves into their neighborhood.

2. (b)

   1. (1) No child may be home schooled if any person residing in the home with the child is required to register as a sex offender.
   2. (2) Upon petition to the sentencing court from the child’s parent or guardian, the sentencing court may enter a written order specifically waiving this restriction.
   3. (3) This restriction shall not apply if the child to be home schooled is the person registered as the offender.
