(a) The FSW will:
(1) For reports of sexual abuse determined to be true and involving an alleged offender under eighteen (18) years of age at the time the act or omission occurred, refer the alleged offender and victim for mental health services by:
- (A) Providing the parents or legal guardians of the alleged offender and victim with a list of mental health professionals or agencies available to evaluate and treat the alleged offender and victim, if necessary; and
- (B) Assisting the parents or legal guardians of the alleged offender and victim with a referral for a mental health evaluation, if necessary; and
- (2) If a protective services or foster care case will not be opened on a true report involving any children in the home under the age of three (3), make a referral to the Division of Developmental Disabilities Services’ Children’s Services for an early intervention screening (see 9 CAR § 40-343, early intervention referrals and services, and related procedures for more information) if the child is not already participating in early intervention services.
(b) The FSW Supervisor will:
- (1) Assist FSW Investigator, as needed, with any referrals; and
- (2) Approve the “Investigation Case Connect” screen as appropriate and assign and open a case if appropriate.
- (c) However, when the Crimes Against Children Division is assigned as the primary investigator and the determination is unsubstantiated, the Crimes Against Children Division will complete and approve the “Investigation Case Connect” screen.
