- (a) Pursuant to Arkansas Code § 12-18-713 the Department of Human Services, Division of Children and Family Services and the Crimes Against Children Division will submit two (2) reports annually on true investigative determinations that are administratively or judicially overturned to the Senate Committee on Children and Youth and the House Committee on Aging, Children and Youth, Legislative and Military Affairs.
(b) Twice annually, on or about June 1 and December 1, the Director of the Division of Children and Family Services or designee will:
(1)
- (A) Request a report summarizing by county the true investigative findings which have been overturned administratively or judicially for the reporting period.
- (B) This report will include:
(i) County of report origin;
(ii) Number of true reports with the finding overturned judicially; and
- (iii) Number of true reports with the finding overturned administratively;
- (2) Provide the completed report to the Senate Committee on Children and Youth and the House Committee on Aging, Children and Youth, Legislative and Military Affairs; and
(3) Respond to subsequent requests for information from the Senate Committee on Children and Youth and the House Committee on Aging, Children and Youth, Legislative and Military Affairs pertaining to the reported overturned true findings by county.
- (c) Information not to be released.
(1) Concerning true findings which have been overturned administratively or judicially, the department shall not release:
- (A) Information identifying the individual family or child;
- (B) Information identifying the individual investigator; and
- (C) Any information if release of such information would identify the individual investigation or individual investigative parties.
(2) The Quality Assurance Unit will:
(A)
- (i) Compile a report twice annually, on or about June 1 and December 1, summarizing by county the true investigative findings which have been overturned administratively or judicially for the reporting period.
- (ii) This report will include:
- (a) (a) County of report origin;
(b) (b) Number of true reports with the finding overturned judicially; and
(c) (c) Number of true reports with the finding overturned administratively;
- (B) Provide the completed report to the director, or designee; and
- (C) Respond to subsequent requests for information from the director, or designee, pertaining to the reported overturned true findings by county.
