1. (a)

   1. (1) Pursuant to Arkansas Code § 10-3-3202 the Division of Children and Family Services will work with the Child Maltreatment Investigations Oversight Committee to promote transparency and efficiency concerning procedures of child maltreatment investigations in the state.
   2. (2) The Child Maltreatment Investigations Oversight Committee will review and evaluate the conduct of child maltreatment investigations completed by the Division of Children and Family Services or the Crimes Against Children Division and service delivery to children and families involved in an investigation of child maltreatment.
   3. (3) The Child Maltreatment Investigations Oversight Committee meetings are closed and confidential.

2. (b) Upon receipt of a request from the Child Maltreatment Investigations Oversight Committee to review an investigation, the CPS Manager will:

   1. (1) Report the review request to the Assistant Director of Prevention and Reunification and the Assistant Director of Field Operations immediately;

   2. (2) Immediately (within twenty-four (24) hours or as required by the Director of the Division of Children and Family Services) print out the prosecuting attorney report pertaining to the identified investigation and inquire for additional information from the following entities, as appropriate:

      1. (A) Area Director
      2. (B) Office of Chief Counsel;
      3. (C) Office of Appeals and Hearings;
      4. (D) Quality Assurance Unit; and
      5. (E) Central Registry Unit;
   3. (3) Document the request for review of the investigation from the Child Maltreatment Investigations Oversight Committee in the contact screen for each investigation to be reviewed;

   4. (4) Within forty-eight (48) hours, ensure that the investigation which is to be subject to the review meets criteria for review by ensuring the investigation:

      1. (A) Is a completed investigation of child maltreatment with no pending due process; and
      2. (B) Is not associated with a pending dependency-neglect case;
   5. (5) Request updated information from the counties as needed;

   6. (6)

      1. (A) Schedule a meeting with the Division of Children and Family Services staff to ascertain information involving facts surrounding the investigation determination if needed.
      2. (B) The meeting will include the following:

3. (i) FSW;

   1. (ii) County Supervisor/Investigative Supervisor;

      1. (iii) Area Director;

         1. (iv) Assistant Director of Field Operations or designee;
         2. (v) The Director of the Division of Children and Family Services or designee; and
         3. (vi) Appropriate staff as needed;
   2. (7) Work with the chair of the Child Maltreatment Investigations Oversight Committee as appropriate in coordinating logistics and necessary reports for presentation to the Child Maltreatment Investigations Oversight Committee;

   3. (8)

      1. (A) Prepare a report of the identified information as well as all records related to the investigation review request and send the information to the members of the Child Maltreatment Investigations Oversight Committee at least ten (10) calendar days prior to a scheduled Child Maltreatment Investigations Oversight Committee meeting.
      2. (B) This information may be sent as hard copies or electronically; and

   4. (9) Prepare a summary of information learned during the review of the investigation by the Child Maltreatment Investigations Oversight Committee to include any Department of Human Services actions and recommendations for the Child Maltreatment Investigations Oversight Internal Review Committee prior to each meeting of the review Child Maltreatment Investigations Oversight Committee.

      1. (c) The Director of the Division of Children and Family Services, or designee, will:
   5. (1) Participate in the Child Maltreatment Investigations Oversight Committee Meetings; and
   6. (2) Ensure reports made by the Child Maltreatment Investigations Oversight Committee to the Senate Committee on Children and Youth and the House Committee on Aging, Children and Youth, Legislative and Military Affairs do not contain information that identifies the subject of a report of child maltreatment or the person who made the report of child maltreatment.
