(a) The facility shall not exceed its total licensed capacity.
(b)
(1) There shall be a staff-to-child ratio of at least:
(A) One to nine (1:9) during waking hours; and
(B) One to twelve (1:12) during sleeping hours.
(2) Staff members’ children shall be counted in the ratio.
(c) If any child is under six (6) years of age, the ratio shall be at least one to seven (1:7) at all times.
(d) Only staff who directly supervise children shall be counted in this ratio.
(e) Childcare staff shall be responsible for providing the level of supervision, care, and treatment that is necessary in order to ensure the safety and well-being of each child at the facility, taking into account the child’s age, individual differences and abilities, surrounding circumstances, hazards, and risks.
(f)
(1) All childcare shift staff counted in the staff-to-child ratio shall remain awake at all times.
(2) House parents are excluded from this requirement.
(g) The facility shall maintain a daily census report to include the child’s name and room or building assignment.
