(b) The agency may discharge a child on an emergency basis if failure to do so could result in:

1. (1) Harm to the child;
2. (2) Harm to others; or
3. (3) Significant property damage.

(c) The agency shall discharge the child to the custody of:

1. (1) The child’s parent;
2. (2) A person with authorization from the parent or guardian; or
3. (3) A person authorized by a court order to assume custody of the child.

(d) The agency shall:

1. (1) Complete a discharge statement on each child that includes the:

   1. (A) Discharge date; and
   2. (B) Reason for discharge; and
2. (2) Provide a copy of it to the child’s custodian.
