9 CAR § 31-208
Exploitation of children
Arkansas Code § 9-28-403
(a) The agency shall not require a child to:
(1) Acknowledge:
(A) Dependency;
(B) Destitution; or
(C) Neglect; or
(2) Make public statements about their background.
(b) The agency shall not use, or allow to be used, any reports, pictures, or other information from which a child can be identified, except under the following conditions:
(1) The child and the parent or guardian sign a consent form that describes the purposes for which the identification is being made;
(2) The signed consent shall say in which publication or broadcast the identification will appear; and
(3) The parent or guardian and child shall be informed that the consent may be withdrawn.
(c) All information regarding children and their families shall be kept strictly confidential and may only be released with the consent of the child or a parent or guardian, except to authorized persons or agencies.
(d) The agency shall document that all staff have been made aware of the need to protect the confidentiality of children in the use of social media.
