(a) The owner or board shall prepare and furnish an application packet for a license that contains the following:
- (1) A completed application form;
- (2) A letter from the agency’s board or owner, as applicable, authorizing a person to sign the application;
(3)
- (A) A copy of the articles of incorporation, bylaws, and current board roster, if applicable, including names, addresses, and contact information of officers.
- (B) Out-of-state agencies shall have legal authorization from the Secretary of State to do business in Arkansas;
- (4) A personnel list with verifications of qualifications and experience;
(5)
- (A) Substantiation of the agency’s financial soundness.
- (B) This shall include without limitation a budget showing sufficient resources to operate for a period of six (6) months, either with resources on hand or with projected revenue from verifiable sources.
- (C) Verifiable letters of financial support and monthly bank account statements may be included to project income;
- (6) Proof of general and professional liability insurance, does not apply to state agencies;
(7) A written description of the agency’s program of care, including:
- (A) Intake policies;
- (B) Types of services offered; and
- (C) A written plan for providing healthcare services to children in care;
- (8) Fire inspection;
- (9) Department of Health inspection, including food service inspection, septic or sewage inspection, and nonmunicipal water sources and general sanitation inspection, as applicable;
- (10) Floor plan with room dimensions;
- (11) Zoning approval, where applicable; and
(12) Any additional information requested by the licensing specialist to:
- (A) Verify compliance with this part; and
- (B) Make a recommendation regarding the granting of a license.
(b)
- (1) Once a completed application packet has been received, the Division of Children and Family Services shall complete a licensing study and recommendation within ninety (90) days.
- (2) If a recommendation is not made within ninety (90) days, the applicant may appear before the Child Welfare Agency Review Board to request a license.
