9 CAR § 30-312 – Selection of foster home

(a)
1. (1) The agency shall select the home that is:
  1. (A) In the best interest of the child;
  2. (B) The least restrictive possible; and
  3. (C) Matched to the child’s physical and emotional needs.
2. (2) The placement decision shall be based on an individual assessment of the child’s needs.
(b) No children shall be placed in a foster home unless there is an approval letter in the record from the approving agency.
(c) The agency shall place children only in approved foster homes.
(d) When a placement agency places a child with another placement agency, the receiving agency shall maintain a record for and provide casework services to the children placed into their foster homes.
(e)
1. (1) Foster homes shall not have more than six (6) foster children in care.
2. (2) A foster home shall not have more than eight (8) children in their home, including their own children.
3. (3) This includes placement or respite care.
(f) Foster homes shall not have more than two (2) children under two (2) years of age, including the foster parent’s own children.
(g)
1. (1) No new placements of children shall occur with foster parents who have not satisfied the annual training requirements.
2. (2) Administrative-level staff designated by the agency director may grant an exemption to this restriction for up to sixty (60) days.
3. (3) The administrator shall review the quality of care provided by the foster parents and the reasons for failing to complete the training on time in deciding whether to grant an exception.
