Unprofessional conduct in the practice of child welfare activities includes without limitation:
- (1) Permitting, aiding, or abetting an unlicensed person in performing activities that require a professional license;
(2) Misrepresenting type or status of:
- (A) Education;
- (B) Training;
- (C) Expertise;
- (D) Licensure; or
- (E) Professional affiliations;
- (3) Failing to maintain confidentiality, except as otherwise required or permitted by law, of all information that has been received from a client in confidence during the course of services;
- (4) Violating the ethical standards adopted by the Child Welfare Agency Review Board;
(5) Failing to report to the Child Welfare Agency Licensing Unit:
- (A) Any disciplinary action taken against the child welfare agency by another jurisdiction; or
- (B) The surrender of a license or loss of authorization to practice child welfare activities in another jurisdiction;
- (6) Failing to comply with any stipulation or agreement with the board involving probation or a settlement of any disciplinary matters; and
- (7) Engaging in behavior that could be viewed as sexual, dangerous, exploitative, or physically harmful to children.
